Overview

This unit describes the skills and knowledge required to define rules of evidence and procedure as they apply to civil and criminal trials, and to evaluate evidence available in connection with the preparation of a case

Assessment

For Melbourne campuses

Assessment tasks will be designed to reinforce and extend knowledge and skill competence within set and controlled parameters in accordance with each unit’s learning outcomes and performance criteria requirements, including the setting of work based practical application tasks designed to provide evidence of competence outcomes, within periodic and scheduled timelines.

Students will be expected to demonstrate the following required skills:
• communication skills to discuss and document findings
• analytical skills to:
• determine types and relevance of evidence
• research and evaluate the development of relevant legislation and provisions

Students will also be expected to demonstrate the following knowledge:
• relevant Federal and State and local government legislative and statutory provisions pertaining to law of evidence
• principles, aims and provisions of law of evidence, including:
o concept and nature of evidence
o no case to answer submissions
o standard and burden of proof in civil and criminal cases
o relevance of evidence
o rules governing examination in chief, cross examination and re-examination
o competence and compellability of witnesses
o rules of evidence
o corroboration warning

Required reading

The qualified trainer and assessor will provide teaching and learning materials as required in the form of workbooks produced by Victoria University Polytechnic and/or via the VU Polytechnic e-learning system.
