Professional Course in Immigration Law

Delivered by the Sir Zelman Cowen Centre, this short course provides an introduction for students wanting to undertake the Graduate Certificate in Australian Immigration Law and Practice.

It can also be taken as a professional development course for those working in the migration sector, including welfare, administration or public sector positions.

It is divided into three modules:

1. Introduction to Legal Studies

Essential skills for using and accessing immigration law, such as:

  • academic writing skills
  • undertaking legal assessment
  • research skills, including how to use electronic resources for cases and legislation
  • reading legal documents
  • referencing and using the Australian Guide to Legal Citation
  • sessions in a computer lab to develop your skills using essential electronic databases

2. Introduction to the Australian legal system and principles

This covers the Australian legal system, statutory interpretation and judicial lawmaking. There will be an emphasis on understanding common legal terms.

Topics include:

  • origins of Australian Law
  • the Australian Constitution
  • parliamentary sovereignty
  • the hierarchy of courts and tribunals
  • separation of powers
  • the rule of law
  • common law vs. statute law
  • statutes (Acts of Parliament)
  • delegated legislation (Regulations)
  • gazette notices
  • ministerial directions

3. Migration legislation and overview

This covers a study of the current legislative and statutory framework, valid visa applications and visa structure, and fundamental application procedures. Topics include:

  • legislative framework
  • legal requirements for a valid visa application
  • Australia’s visa structure - visa classes and subclasses, substantive and nonsubstantive granting, evidencing, re-evidencing, voiding and cancelling of visas

Course contents

Introduction to Legal Studies This module comprises sessions on academic writing skills, undertaking legal assessment, research skills including how to use electronic resources for cases and legislation, reading legal documents, referencing and using the Australian Guide to Legal Citation. These are all essential skills to using and accessing immigration law. A number of sessions will be held in a computer laboratory to ensure you are able to develop your skills using essential electronic data bases. There will be an emphasis on practical writing exercises and in particular specific classes in planning and editing your work. The teachers are all experienced in developing the foundation skills required for working or studying in a legal environment Introduction to the Australian legal system and principles This module covers the Australian legal system, statutory interpretation and judicial lawmaking. Topics include: • Origins of Australian Law • The Australian Constitution • Parliamentary sovereignty • The hierarchy of courts and tribunals • Separation of powers • The Rule of Law • Common law v Statute law • Statutes (Acts of Parliament) • Delegated legislation (Regulations) • Gazette notices • Ministerial Directions Migration legislation and Overview These sessions include a broad overview of the history of immigration law, a study of the current legislative and statutory framework, valid visa applications and visa structure and fundamental application procedures. In addition to ensuring students understand the broad legal context specific introduction to visas classes and applications will provide detailed understanding how the system operates. Topics include: • Legislative framework • Legal requirements for a valid visa application • Australia’s visa structure including visa classes and subclasses, substantive and non-substantive visas, granting, evidencing, re-evidencing, voiding and cancelling of visas.

A comprehensive introduction to the Academic study of Immigration Law.

The course consists of 32 hours of study and optional assessment. It is scheduled over two weekends. The objectives of the course are to give all students a comprehensive introduction to the study of immigration law including developing legal literacy and study skills.

Admission Information

Preference will be given to those that have been advised that it is a prerequisite to being given a place in the Graduate Certificate program. Places are allocated in order of receipt of full payment and a completed registration form.
